MINUTES—September 2, 2003

Members Present:  Matt Hart, Chairman, Murray Johnson, Paul Donovan, Lee Scarborough, Eric Winer, Fred Clancy, Bill McShane

 

Members Absent:  None

 

Other Attendees:  Tom Leach, Sid Zeigler, BOS, Ren Nichols, Dave Nolan, Arthur Cote, Michael Schreibman and other Harwich residents.

 

MEETING OPENED:  7:00pm @ Harwich Community Center

COMMUNICATIONS:

OLD BUSINESS:  None

 

NEW  BUSINESS: 

 

1.      A Motion was made and seconded to put Ronald Vokey back on the 30ft list (slip in Saquatucket Hbr) and passed unanimously.

 

2.      The Special Fishing Permit was approved by the BOS and is now a regulation.

 

Fred Clancy took exception to allowing Non-Harwich Charter Boats from having access to

the Fuel Truck for the reduced fuel rate. He did not want the Special Fishing Permit to

include the Fuel Truck access.

 

3. A Motion to approve the Minutes of July 21, 2003 was made by Murray Johnson, seconded by Paul Donovan and passed unanimously.

 

4.         From this point on this meeting was entirely devoted to a continued discussion of the document authored by Chairman Matt Hart, entitled—Potential Concept, Revised July 21, 2003.

 

·        Chairman Matt Hart opened the meeting for public comment.  Jamy Madeja, Esq and Michael Schreibman spoke.  At 7:25pm there were no further public comments and Chairman Hart closed the meeting to public comments.

·        Chairman Hart read each section of the “Concept” document and allowed comments from the floor.

§         ¶1.  Discussion of this paragraph was very detailed and individuals contributing were: Tom Leach, Murray Johnson, Dave Nolan, Craig, Mike Schreibman, Ren Nichols, Chairman Matt Hart, Ted Vrountas and Lee Scarborough.  When all points were heard, Chairman Hart closed the discussion.  The Committee discussed several points. 

·        MOTION:  To change ¶1.  Eric Winer made the motion, seconded by Murray Johnson and passed unanimously.  The text of that motion is as follows:

o       All applicants who have properly filed with the Harbormaster for the Mooring Waiting List and/or the separate Town Slip Waiting List for salt water in the Town of Harwich will be listed (unless awarded under the Town of Harwich Special Purpose or Commercial Moorings) on the Consolidated Waiting List*.  These lists would be according to the specific location desired  (Saquatucket Harbor, Wychmere Inner Harbor, Wychmere Outer Harbor, Allen Harbor, Herring River, Red River Beach, Pleasant Bay, Round Cove).  Business entities will keep a separate waiting list for moorings and these lists will be turned in to the Harbormaster* and published yearly.

§         ¶2.  Discussion of this paragraph was opened and Ted, Murray Johnson, Tom Leach and Ren Nichols were heard.

·        MOTION:  To approve ¶2 as written by Fred Clancy, seconded by Paul Donovan and passed unanimously.

 

§         ¶3.  Discussion of this paragraph was opened and Tom Leach and Paul Donovan were heard.

·        MOTION:  To move “Other Mooring Information” (from §3.13 Harwich Waterways Regulations) to after “General Tackle Requirements” was made by Paul Donovan and seconded by Murray Johnson.

·        AMENDMENT TO MOTION:  To move #8 “General Tackle” and combine with #2 “Other Mooring Regulations”, using the whole text of #8 “General Tackle” and omitting sentence #1 of “Other Mooring Regulations”(#2).  This Amendment to the motion was made by Murray Johnson, seconded by Lee Scarborough and passed unanimously.  The Motion itself was then passed unanimously:

 

3. HARWICH MOORING & BOAT STICKER:

 

All Boats in Salt (and Fresh)* Water Mooring areas in Harwich are required to apply for a matched pair of Mooring stickers annually for all Moorings in the Town of Harwich. The Boat is required to have a numbered Harwich Mooring Sticker with ID Number attached to the stern of the respective boat. The Mooring is required to have a matching ID Number attached to the mooring next to the printed name of the current Mooring Holder.

This section will be taken care of by the modification Section 3.13 of the Harwich Harbor Management Plan:

 

3.13 Mooring Tackle & Equipment

 

These specifications are established to set safety standards for vessel moorings at Harwich. Per Order of Harbormaster T.E. Leach (4/1/88).

 

GENERAL TACKLE REQUIREMENTS

 

1. Mushroom anchors only and of adequate size as per Table 1.

 

2. Adequate chain lengths in accordance with specifications Table 2.

 

3. All moorings must be of soft foam or plastic material. Color must be white with a blue band. MOORING NUMBER and last name must be painted on mooring with contrasting oil-based paint (no marker pens, please!)

 

4. Mooring painters and lines must be of a non-floating type material. No hemp, manila, or polypropylene. Painter length should be adapted to vessel foredeck configuration. The painter thickness must be in accordance with Table 3. Double painters are recommended for all non-protected areas.

 

5. All shackles must be secured with: stainless wire; 12GA copper wire or tough plastic cable ties.

 

6. All mooring permits and fees must be renewed annually. All moorings must be inspected and site approval determined by the Harbormaster prior to dropping it.

 

7. Winter mooring sticks must float at a 45-degree angle, show 18" above water and painted white tip with number.

 

 

Other Mooring Information

 

1. Acceptable applications will receive one float permit tag and one corresponding transom sticker which will be mailed to your winter address (please indicate otherwise). Boat yard operators will be given stickers and tags.

 

2. All boats shall display current Harwich mooring transom sticker on upper stern starboard corner.  All moorings shall be tagged with current Harwich mooring tag.  The mooring tag shall be affixed and visible on the float.

 

3. A copy of current harbor regulations will be made available on request. Failure to comply with any and all regulations will result in loss of mooring privileges.

 

4. The Harbormaster reserves the right to charge for any alterations or services provided to any mooring or boat in addition to the permit fees

 

5. Although insurance remains optional, information is requested on the application to understand how many boat owners carry this form of protection.

 

6. All mooring anchor systems must be inspected in alternate years. This inspection report is public record and will be made available to insurance adjusters on demand. It is in your interest to make sure that this inspection is completed and recorded.

 

These specifications are established to set minimum safety standards for vessel moorings at Harwich in normal conditions.

 

§         ¶4.  Chairman Hart opened the floor to discussion and many were heard—Ted, Tom Leach, Dave Nolan, Lee Scarborough, Chairman Matt Hart and Murray Johnson.  Discussion was closed to the floor a motion entertained.

o       MOTION:  To approve as written ¶4 by Murray, seconded by Bill McShane and approved by a vote of 4 (yes) to 2 (no)—Yes votes from Matt, Murray, Eric & Bill, No votes from Paul & Lee.

§         ¶5.  Chairman Hart opened the floor to discussion and several were heard—Lee Scarborough, Tom Leach, Chairman Hart, Murray Johnson and Clem.  Paul Donovan left the discussion due to his belief in a possible conflict of interest.  Discussion was closed to the floor and a motion entertained.  Eric made the motion, Bill seconded and passed unanimously.

§         ¶6.  Chairman Hart opened the floor to discussion and a motion was quickly entertained.  Lee made the motion, Bill seconded and passed unanimously.

§         ¶7.  Chairman Hart opened the floor to discussion and a motion was quickly entertained.  Chairman Hart made the motion, Murray seconded and passed unanimously.

§         ¶8.  Chairman Hart opened the floor to discussion and a motion was quickly entertained.  Chairman Hart made the motion, Lee seconded and passed unanimously.

o       MOTION:  to TABLE until 9/17/03 meeting and have Tom Leach research this topic.

§         ¶9.  Chairman Hart opened the floor to discussion and a motion was quickly entertained.  Murray made the motion, Chairman Hart seconded and passed unanimously.

o       MOTION:  To include ¶9 (Army Corps of Engineers) and §III (Severability) in the final document.

 

ADJOURNMENT:  10:25PM a motion to adjourn was made by Lee, seconded by Paul and voted unanimously with the next meeting to be a Special Meeting, Tuesday, September 2, 2003 @ 7:00pm @ the Harwich Community Center.
