OLD BUSINESS:

Continuation of Mr. Tom Birch’s Show Cause Hearing from 8/20/02. The applicant and his attorney were reminded that all that the Waterways Commission could consider was Mr. Birch’s eligibility for a Charter Permit based on having a full season, Boat Slip or Mooring in the Town of Harwich. Lacking that slip or mooring, the Waterways Commission has no options other than to acknowledge, without prejudices that any changes to the regulation are under the jurisdiction of the Town of Harwich Board of Selectmen.

A motion acknowledging: “Mr. Birch’s decision to request a meeting with the Board of Selectmen without prejudice from the Waterways Commission,” was made by Eric Winer, seconded by Paul Donovan. The vote was three in favor, one abstention (Fred Clancy).

Continuation of Mr. Leon Pasani documentation for slip assignment.  The applicant and his partner Robert Bogardus provided the requested documents.

A motion was made by Eric Winer to: “Accept the Documentation and approve the Slip Assignment as requested”. Seconded by Paul Donovan. Unanimous vote in favor of motion.

Continuation of Mr. Michael Rubin Show Cause Hearing, was a no show.

Continuation of Mr. Stephen Sawicki Show Cause Hearing, was a no show.

Harbor Master Tom Leach asked for a 30 day extension to allow for the two individuals to have a full 30 days to respond.

A motion was made by Eric Winer and Seconded by Fred Clancy to: “Continue both hearings until the next Waterways Commission meeting.” (09/15/02)  Unanimous vote in favor of motion.

NEW  BUSINESS:

Discussion about the request from three individuals for an “E” Class permit.

Mr. Gene Terrenzi spoke to the members about why he was requesting an E Permit for use

For fishing out of Allen Harbor.

The Waterways Commission accepted the four letters requesting the E Permit and decided to add the discussion and decision at a later scheduled Waterways Commission Meeting.

Discussion about the previously approved Waterways Commission request by the Commercial Fishermen A Permit holders to extend their permits to allow for more than 30 days per year for Charter Fishing.

The Waterways Commission previously approved expanded ““ requirements:

“A” permit holders must request a “Waver” at a hearing with the Waterways Commission for expanded Charter Fishing beyond 30 days.

Requirement of compliance would be the use of a “Log Book” to record the actual charters.

This request will be presented to the Board of Selectmen in October.

ADJOURNMENT:

Motion to adjourn at 8:30 PM
