Waterways Commission Meeting REGULAR MEETING Harwich, Massachusetts Community Center Room #4 MINUTES—May 24, 2005 Meeting Called to Order 7:15 PM Members Present: Paul Donovan Chairman, Murray Johnson, Matt Hart, Bill McShane, Lewis Williams, Fred Clancy Members Absent Other Attendees: Tom Leach (Harbormaster), Dan Lowery, John Our, Clem Kacergis, MINUTES READ NEW BUSINESS: TOWN ADMINISTRATOR REQUEST: HARBORMASTER ITEMS: 1. Harbor Master Tom Leach told Commission about Costal Zone Management to manage commercial leaching pits, to catch bottom paint chips and residue. This has been an issue for a while. 2. There is an available “E” permits; Len Greiner is next on list. Boat to be used for commercial fishing or charter fishing. Mooring in Wychmere Harbor. Harbormaster recommends the permit be granted. MOTION: by Bill McShane SECOND: by Murray Johnson ACTION: passed unanimously COMMUNICATIONS: 1. Mr. Lee Scarbrough has submitted his resignation from the Commission. The Board of Selectmen accepted the Letter. We wish to thank Lee for his years of service to the Town on the Commission. OPEN FORUM: APPEALS: 1. Pleasant Bay Community Boating two moorings for rowing and sailing instructions. The group is non-profit and not on the waiting list. Requesting 2 Special Purpose Moorings. Motion: to grant appeal Second: Action: Motion carries 3 – 1. To be forwarded to the Board of Selectmen. 2. Susan Holland: appealing mooring forfeiture because of nonuse, appeal granted 4 – 0 – 0. 3. Kenneth Simpson: appealing loses of mooring due to Board boat use. Appeal denied 4-0-0 4. James Travers; appealing lose of mooring due to missing March 1 deadline. Appeal accepted on a 3-1-0 vote 5. Jonathan Small appealing being dropped from the waiting list because of missing deadline. Motion to accept appeal passed 3-0-1 6. Gary Couture appealing loses of mooring due to missing application deadline. Motion to grant appeal 3-0-1 7. John Doherty appealing loses of mooring due to non-use and use of board boat. Moved to deny appeal 4-0-0 8. Ellen Carr moved to grant appeal 9. James Brockman moved to grant appeal passed 3-1-0 10. John Frazie moved to grant appeal passed 3-1-0 11. Bernard Trombly: no action needed NEW BUSINESS: 1. Dave Nolan Cape Yacht Sales, requests that his berth in Saquatucket Harbor be used as a dealership for demonstration or set up of boats, instead of recreation for the season.
