Waterways Commission Meeting REGULAR MEETING Harwich, Massachusetts Small Meeting Room, Town Hall MINUTES—June 21, 2005 Meeting Called to Order 7:10 PM Members Present: Paul Donovan Chairman, Murray Johnson, Lewis Williams, Fred Clancy, Dan Plunkett. Members Absent: Bill McShane (excused), Matt Hart Other Attendees: Tom Leach (Harbormaster), Dan Lowery, Rich Francis, Robert Peterson (Selectman), Peter and Kara Spalt MINUTES READ 1. Feb 15, 2005 accepted unanimously 2. March 15, 2005 accepted as corrected 3. April 27, 2005 accepted unanimously NEW BUSINESS: TOWN ADMINISTRATOR REQUEST: HARBORMASTER ITEMS: 1. Dredging entrance to Round Cove. Information from Mark Novata of Wequasett Inn, stating that if sand from dredging is placed on beach east of the cove, which is near gone, the Inn would be willing to partial fund the project. 2. Paid Parking at Saquatucket Harbor. Use of Kiosk system would be $13,000 per unit plus yearly service cost. The Harbor Master favors a manned drive through booth at the entrance. Fred Clancy stated that this idea was not Harwich friendly. COMMUNICATIONS: E-mail from Harwich Port Boat Yard concerning MSA problem with mooring holder. Attached letter informing Ms. Morris that Harwich Port Boat yard no longer will act as their MSA. (See below) OPEN FORUM: 1. Dan Lowery Harwich Port Boat Yard informed the Commission of problems he is having with Nancy Morris mooring permit # 219. In 2004 no mooring in the water, and boat was hauled out of the water. There was a conflict with the mooring inspection. The boat came into the harbor 2005 with Mr. Jim Chalmers at helm and had no mooring to tie up to. Subsequent phone conversation with Mr. Chalmers involved obscene language from Mr. Chalmers to Dan. Conflict today 6/21 with Chalmers and Nancy Morris. This is informational from MSA to WWC. 2. Len Grenier requested that a permit be created establishing a “C –12” category. This would be a C permitted boat inspected by the U.S. Coast Guard as A Small Passenger Carrying Vessel with a capacity of up to 12 people. WWC members said it was a D permit, and that providing suitable off site parking would be the first hurdle of the idea. Action: Table till July meeting APPEALS: 1. Richard Francis appealed losing spot on Herring River wait list for non-payment. Mr. Francis paid $110 he thought for mooring permit in Pleasant Bay and the Wait List. The Fee was actually $110 for the mooring permit and not the Wait list. Motion: by Murray Johnson to accept appeal and place Mr. Francis back on the Herring River Wait List. Second: by Fred Clancy Action: Appeal granted NEW BUSINESS: 1.HMP Definitions. Commercial Fishing Boat: MOTION: to amend the HMP definition of Commercial Fishing Boat by eliminating the sentence starting with Any use for the purpose…. The HMP in other sections allows A and E permit boats to take charters. ACTION: 2. “R” permits Motion: to amend recommendation of WWC to set the number of of permits at 10 ACTION: 3. Transfer of “D” for The PERSEVERANCE, from Alan McMullan to Peter Spalt. Chairman Paul Donovan reclussed chair to Murray Johnson because of conflict. Mr. Donovan holds a “D” permit. The “D” wait list is as Follows Carl Schotte, Alan McMullan, and Peter Spalt. Mr. Schotte agreed to pass on the slip; Mr. McMullan passes, to give the slip to Mr. Spalt. Motion: by Fred Clancy Recommends there transfer of the D permit from McMullan to Spalt with the agreement that he will provide proper off site parking, and that McMullan’s position on the D list #2 goes now to the bottom. Second: ACTION: passed unanimously NOTE: Alan McMullan currently holds 2 “D” permit and is # 2 on the “D” list. As Carl (#1 on the list) has Told the Harbor master today 6/21/05 on satellite phone that he will step aside and take a “by” to allow Alan to sell his business and boat to Spalt (#3 on the list. Alan (#2 on the list) cannot take a “by” because he could not ever accept another “D” permit. What would be the point of him taking a transfer of the permit from his own “D” permits? Taking a “By” means that he cannot sell the boat to himself, so he must drop to the bottom of the list. ADJOURNMENT: Motion to adjourn 9:02 PM 1
